I’m not saying I like this policy, but it seems to me that the Yankees are within their rights to enforce it on their own property.
Also, this guy should get over himself. If he was just going to the bathroom then how was he discriminated against based on his political or religious beliefs? He only pees during God Bless America? Is he a need-to-pee-American? What a frivolous lawsuit.

So if I leave my seat in the top of the 7th, and get in a line to buy some overpriced beer, and there are three quick outs while I’m in line, they have the right to arrest me and have me removed?
There must be 100s of people out-and-about during the playing of Dog Bless America. If it were Dodger Stadium, tens of thousand would be on their way to the exits.

Discrimination based on religious beliefs:
God Bless America is basically a song about praying to God and asking him to bless America. My guess is that case will be that forcing a person to stay in his seat and “pay respect” to a song about God (even if God isn’t its only subject, or even its main one ) hurts his religious freedom, and that punishing him for not doing so is discrimination based on religious believes. The case would have been more clear had the song referred to a specific God, religious messenger, religious symbol, etc. If, for example, the crowd were forced to sit and listen to “Muhammad Bless America”, I’m sure that many people would be outraged. This is essentially the same – freedom of religion includes, by default, freedom from religion.
Discriminated based on political beliefs:
Basically, you can’t force a man to love America, nor can you punish him for not doing so. Praying for the well being of America is a political statement, even if a very very mild and basic one.
Yeah, this looks like a pathetic attempt to get some easy money and few minuets of fame, but that doesn’t mean that the man has no case.

I’ve become increasingly uncomfortable with the term over the years because of how it’s used, yes. I’m also totally down with James Baldwin, who said, “I love America more than any other country in the world and, exactly for this reason, I insist on the right to criticize her perpetually.” It’s a pity that most people are too dumb to understand that that’s what patriotism should mean.

“Patriotic” is one of those terms that everybody seems to co-opt, redefine arbitrarily, and then regurgitate incessantly, which makes it essentially meaningless.
Some people claim to be patriotic because they support the war, others because they actively oppose it. Some people claim to be patriotic because they want less taxation (it’s what our founding fathers intended!), others because they want more taxation (Love your country? Fund it!). Some people claim to be patriotic because they wave flags, others because they burn them.
It’s a freaking buzzword. It’s essentially marketing.

Alright, so it might be a good song, but it’s not the national anthem. You get up and take your cap off during the nation anthem. I don’t care if you don’t do that, but that’s what I do. But even at the SJ Giants game last night, they said “please rise and remove your caps for the singing of God Bless America.” It’s not like I hate the US but, it’s just a song.
