Bonds tested positive?

Sorry if this was already posted somewhere or it's a crap report, but ESPN, the mother of all sources, just said the New York Times told them there's collected urine samples from BLB that tested positive for anabolic steroids.  If this is true, then uh ohhhh.  Anabolic steroids were always illegal, unlike the clear.  His trial is set for March 2nd and, if this is true, this could be pretty bad for Barry, no?  I guess he aint playin next year.  ESPN also mentioned Anderson's mother-in-law's house being raided, but there was already a fanshot about that.  Why are we even spending this much time and money on this anyways?  Obama spare us from this madness...

This Is Old News

It is the Balco initiated test from the end of 2000 that Has all kinds of “Chain Of Custody” Issues. There is even some documentation that indicates that it was actually Anderson’s test results not Barry’s. Barry’s defense team has challanged the admissability of these results on the basis of this and even if the Judge decides to admitt it they will still be able to bring up the serious questions with regards to chain of custody and who was actually being tested at trial. This is by no means a smoking gun.

by giantsrainman on Jan 28, 2009 9:50 PM PST reply actions   0 recs

P.S. They Don't Have The Actual Urine Samples But Rather Just Test Rusults

Again, proving these test results are actually Barry’s is going to be very hard for the Feds to do.

by giantsrainman on Jan 28, 2009 9:52 PM PST reply actions   0 recs

I’m pretty sure you’re right, that this is yet another reference to evidence gathered in the original raids of BALCO and already reported umpteen times since then, even just two weeks ago in reports of the filing by the defense to block certain items of evidence.

Victor Conte described those BALCO tests in an AP article in November 2007.

However, the wording of the New York Times article on which the ESPN material is based clearly implies that the feds have urine samples:

A person who has reviewed the evidence said that the authorities detected anabolic steroids in urine samples linked to Bonds that they gathered in connection with their investigation. The person spoke on the condition of anonymity.

Now that would be news. But for

This Doesn't Say They Have Urine Samples

It says that tests performed on urine samples detected steroids. We know from previous leaks that these tests were performed at Balco’s request by Quest Labs in December 2000. The “authorities detected anabolic steroids in urine samples linked to Bonds” by reviewing the test data from Quest Labs. The authorities linked these urine samples to Bonds by reviewing the doucumentation they ceased when they raided Balco back in 2003.

You don’t have to tell me what it means. In the context of the case it’s suspiciously vague.

However, many people will assume — are assuming — that “the authorities” refers to the Federal government and “their investigation” refers to the perjury case. And that’s probably the whole point, to imply that without actually saying it.

But anyway. Business as usual.

I was about to write some crazy paranoid crap such as, “But for the fact that the mere presence of anabolic steroids in urine is no more remarkable than the presence of digestive enzymes in spit, I’d say that the prosecution might actually have something here, if this strategically placed leak is true and accurately reported.”

But I stopped myself just in time.

I do love the fact that giantsrainman’s homerism extends to legal matter as well

by FluLikeSymptoms on Jan 29, 2009 11:46 AM PST up reply actions   0 recs

I would be tempted to say that the leak we’re discussing was probably prompted by public sentiment that the prosecution of Bonds has been frivolous, which has spread of late beyond the core group of Lunatic Fringe Giants homers, and by the desire to cast any possible judicial decision to disallow disputed evidence in as unpopular a light as possible — but I’ve resolved to stay away from this subject, so I won’t.

by 2X2L on Jan 29, 2009 12:24 PM PST up reply actions   0 recs

I agree with all of that, and I think this prosecution is absolute bullshit. I’m just amused by the fact that he rushes to defend Barry’s legal situation in this same way he rushes to defend “Pablo Sandoval is more valuable than Russel Martin.”

Or perhaps he feels that he was intentially mislead by the Feds to believe that he would not have to testify if he plead guilty and therefore is not going to cooperate with the Feds whom he now views as scum no matter what.

Bobby Estallela's Testimony Will Most Likely Be Hearsay An Thus Not Admissable

I seriously doubt if Barry ever talked to Bobby about using steroids or ever used steroids in Bobby’s presence. All Bobby can testify to is what he heard from Greg Anderson. The Feds will try to get this in by arguing that Anderson’s refusal to testify is evidence of a conspiracy between him and Bonds and thus Estallela’’s hearsay testimony should be admissable under the conspiracy exception for hearsay. The Feds are not going to win this arguement since if they could prove this conspiracy they would be charging both Bonds and Anderson with this far more serious crime in addition to the perjury and obstruction of justice charges Barry currently faces.

FWIW, every account that I’ve ever heard of Barry dealing with fans has been glowingly positive.

Of course, it isn’t worth much because second and fifth-hand accounts of various 30-second interactions aren’t by nature worth much, but it is there. He had an awful relationship with the media, but that’s as much as I’ll ever say about his person with any confidence. Which is fine. I don’t really care either way. He was a great, great player.

I Know This From Personal Experience

In 1998 during Easter break I took my wife and kids to Arizona for Spring Training. The first game we went to my son (12 at the time) wanted to get as many autographs as he could. He got Barry to sign and Barry even posed for a picture with Mikey that I took. That night at dinner I didn’t see that Barry was there but he must of seen and recognized Mikey because he came over and said hi to Mikey by name. He also agreed to pose for a second picture with my two girls.

I have little doubt that he can be a jerk but I also know for a fact that he is not always a jerk.

“Cheater” is a term ESPN has made you accept. They forget to mention that “The Clear” wasn’t against the rules or the law. If you really think Bond’s is going to jail you haven’t done your research on the issue. The Fed had no case to begin with, spent $60 million going after athletes that used a LEGAL supplement, knowing full well the only thing they could do is get them to commit perjury, and Bond’s lawyers are eating the prosecution for breakfast.

I don’t know Barry Bonds as a person, nor will I ever. I do not care what he is like as a person. I watch him play baseball, and he did that better than anyone else I’ve ever seen in my life, while playing 15 years of his career on my favorite team. He has not ruined any image, rather he’s been crucified by the media and I for one will not stand for their bullshit.

I’ve read Griffey had his own lounge chair and tv set, but you never hear anyone making a big deal about that. Rob Dibble from Best Damn has commented on that whole thing and said the treatment Barry got was not that uncommon for star players. Sure you may object to it but using that as evidence for what a terrible person/teammate Bonds is is complete horseshit.
