Union Files Grievance Because Buster Posey Got More Money Than Pedro Alvarez
Not sure if anyone's seen this, but per MLBTR there's Drama Over Pedro Alvarez Contract
2:07pm: MLB.com's Jenifer Langosch talked to a source who said Boras wants another $200K, so that Alvarez's bonus matches Buster Posey's.
12:57pm: Turns out Pedro Alvarez has not reported to the Pirates yet for a reason - the Players Association filed a grievance on his behalf today. They're saying Alvarez verbally agreed to his $6MM bonus after the midnight deadline on August 15th. Scott Boras informed the Pirates that Alvarez will not sign the contract unless it is renegotiated at a higher number. Royals top pick Eric Hosmer may also become tangled up in this mess, since his contract was submitted after Alvarez.
Here is the Pirates' Statement
"At the Pirates' request, the Office of the Commissioner today placed Pedro Alvarez on Major League Baseball's Restricted List. The Pirates were forced to request that Pedro be placed on the Restricted List because we were informed by his agent, Scott Boras, that Pedro will not sign the contract to which he agreed on August 15. Boras further informed us that Pedro will not report to the Club unless we renegotiate his contract and agree to pay him more than the $6 million signing bonus to which he agreed.
"The Major League Rules provide that a player who refuses to sign a Uniform Player Contract to which he has agreed and report to the signing Club shall, upon a report of the signing Club, be placed on the Restricted List until he signs a contract reflecting the terms to which he has agreed. Such a player may not sign a contract with or play for any other Club. While demanding that we renegotiate his contract and pay Pedro more than the $6 million signing bonus to which Pedro agreed, Mr. Boras has contended that the contract we reached with Pedro was consummated after the August 15 deadline. This claim was not raised on the evening of the 15th when we informed Mr. Boras that Major League Baseball had confirmed that the contract was submitted in a timely fashion. Mr. Boras asserted this claim several days later, after all of the draft signings had become publicized.
"The Pirates are confident that the contract reached with Pedro Alvarez was agreed to and submitted to Major League Baseball in a timely fashion and properly accepted by Major League Baseball. In fact, the contract between the Kansas City Royals and Eric Hosmer, another Boras client, was submitted to the Office of the Commissioner after our contract with Pedro was submitted. Mr. Boras is apparently satisfied with the $6 million bonus that he secured for Mr. Hosmer and has not challenged the validity of that contract. Mr. Boras has been informed that if he pursues a claim that our contract with Pedro was not timely he puts Eric Hosmer's contract with Kansas City in jeopardy.
"The Pirates made several attempts to commence negotiations immediately following the draft and were willing and ready to agree to pay Pedro a $6 million signing bonus from the very outset. Predictably, however, Mr. Boras refused to engage in any negotiations at all until shortly before the August 15 deadline and even then an agreement was reached only after Pedro took control of the negotiations.
"Regrettably, we are not surprised that Mr. Boras would attempt to raise a meritless legal claim in an effort to compel us to renegotiate Pedro's contract to one more to his liking. We are, however, disappointed that Pedro would allow his agent to pursue this claim on his behalf. Pedro showed tremendous fortitude and independent thinking when he agreed to his contract on August 15.
"The Office of the Commissioner has assured us that we have a valid contract with Pedro and that it will vigorously defend any claim to the contrary. Despite our disappointment, we continue to believe in Pedro Alvarez the person and the baseball player and remain excited to add Pedro to our system. We will sit down with Pedro and his family as soon as Mr. Boras' claim is rejected to chart a new and much more productive start to Pedro's career with the Pittsburgh Pirates."

Rather it’s about Boras getting a hollow victory and then having more prospects line up to have him be their agent. Because Scott Boras will fight for you! Then he’ll take his negotiated percentage out of those over-slot contracts he’ll deliver in the 11th hour…or the 505th, whatever floats his boat.

Does it really matter if Alverez is all huffy? The Pirates now control him for at least six years, and he can pout all he wants. All he would be doing is killing his future. Manny, at least, had to have monster career nuimbers before he pulled a stunt like he did. If Alverez is on the Restricted LIst, he can’t be signed by any other team, and he can’t reenter the draft. before the draft, there was reportedly a figurative pissing contest between Posey’s agent Jeff Berry and Boras over who would get the biggest bonus. Posey’s contract got done right at the deadline and as it turns out, he got more than Alvarez, but there was no time to redo the Alvarez deal to be the same or more than Posey’s. Apparently, that doesn’t stop Boras. This more about Boras than about Alvarez. Ridiculous.

Here’s something I don’t understand, though: If the signing deadline has passed, how can the contract be renegotiated? If the contract really is invalid like Boras claims it is, then Alvarez can’t be signed until after next year’s draft. What am I missing?

That both Pedro and Hosmer were granted extensions past midnight by MLB to get their deals done….but even if this were true, I dont think that MLB is going to grant him another (10+ day) extension to RE-negotiate a contract that MLB has already signed off on. SUCK IT BORAS

The agent certification is awarded by MLBPA
not the league. It’s there to protect the players, not the owners.

Boras is a lawyer
and is still active. He is bound by the California Rules of Professional Conduct, which includes conflicts of interest. Even if Hosmer doesn’t get screwed, Boras could get in hot water with the bar.

Well, it ultimately rests with the MLBPA whether he can represent players, correct? I mean, theoretically he could be disbarred and still be certified, if the MLBPA so choose?
My original point was that I think given his standing with the MLBPA and players around the league, he’d have to do something egregiously illegal or incompetent to lose his ability to represent players. It depends on what the rules for certification are, though theoretically, I suppose he could be sanctioned and maintain his agent certification.
Though, getting sanctioned by a state bar because he violated conflicts of interest rules (put his own or one client’s interest over that of another) would definitely hurt his standing with future and/or current clients.

I’m not suggesting the bar would do anything without a formal complaint, which I doubt there would be, but he is still bound by his professional ethics and I’m not totally sure, but I don’t think he can hide behind the argument that he wasn’t acting as a lawyer at the time, though this perhaps isn’t an attorney/client relationship. Lawyers get in trouble all the time for stuff they do outside their practice of the law that violates their ethics.

Though I think Jim Callis can explain it best: “It’s interesting to note that Boras tried the same thing with A-Rod in 1993. After a long holdout, the family asked someone else to talk to the Mariners on their behalf and a deal was reached. Boras filed a grievance saying that the team ignored A-Rod’s right to his chosen representative, and wanted A-Rod granted free agency or (sound familiar) the right to renegotiate. The Pirates’ statement says that "an agreement was reached only after Pedro took control of the negotiations,” so I wonder if that’s the basis of Boras’ complaint. That didn’t work with A-Rod, though."
Similarly, in 2001, Andruw Jones and his father went around his rep, Boras, to make a deal with the Braves, which Boras (I think) tried to have voided because it wasn’t finalized by Jones’s rep on record. It sounds like in this case, Alvarez and his family agreed to the deal, and Boras is trying to say that nothing was formalized at the deadline, etc. so he can negotiate a payday that tops Poseys. Boras has stated repeatedly that he’s not a fan of the Aug 15 deadline, and this in all likelihood is a play to try and bust that wide open. Can’t see how he succeeds, though.

Well, he didn’t really get away with it because he lost both times; the Mariners/A-Rod and Braves/Jones contracts were upheld, but yeah, it’s amazing that he still gets to much leeway.
I think to this point he’s been seen as a nuisance (holding players out for a year to re-enter the draft, etc.), but has done things above board. MLB and the teams have been watching him closely though – I mean, I don’t think the Pirates could have put out a more perfect statement. “Try to fuck with us? Okay, player to the restricted list; Boras is an asshat, Alvarez you’re cool just don’t listen to your agent.” It’s like they knew this was coming…

You know, I’ve never had much of a problem with Boras up until now. I always felt he was just doing his job and he was damn good at it. It was frustrating for the fans and owners, but he was usually acting in his players’ interest. Recently though, not so much. In fact, the contract between the Kansas City Royals and Eric Hosmer, another Boras client, was submitted to the Office of the Commissioner after our contract with Pedro was submitted. Mr. Boras is apparently satisfied with the $6 million bonus that he secured for Mr. Hosmer and has not challenged the validity of that contract. Mr. Boras has been informed that if he pursues a claim that our contract with Pedro was not timely he puts Eric Hosmer’s contract with Kansas City in jeopardy.
And that’s the guy who wasn’t involved. If you’re telling me that this $200,000 gain, which represents a 3% increase over the $6 million he already got, is worth this move, then I’m calling bullshit.

I think the reason people are jumping on Boras
is that, at least, at this point, it doesn’t appear to be in his clients advantage to pull this stunt.
$200K is peanuts compared to what Pedro Alvarez will get in free agency, assuming that he’s any good. For top talents, the goal should be to get to FA as quickly as possible, not delaying the FA years you get by haggling over a few hundred thousand dollars.

Scott Boras is going to keep doing this shit until major league teams no longer allow him to do so. The Pirates’ comment about still looking forward to having Alvarez on their team tells you that they are eventually going to cave. I know it would be tough for a struggling Pittsburgh organization to do, but if they told Alvarez he was no longer wanted and actually followed through on this, it would be the beginning of the end for Scott Boras and his tactics. Tim Lincecum was saying that Buster Posey is going to be treated differently by other Giants’ farmhands because of the large bonus he received. Can you imagine how Pirates’ farmhands will treat Alvarez after this thing gets settled??

They won’t have to cave, though. By placing Alverez on the restricted list, he cannot sign a contract with any other team, or reenter the draft. Boras will get a lot of press for this crappy little stunt, then he wiil quitely drop the lawsuit and Alvarez will report to rookie league at the end of this year or early next year without his extra $200K. The examples above show Boras has tried this kind of stuff before. He did with Angel and the Giants, and it just quietly goes away.

but he didn’t sign the contract yet… which means technically he isn’t an MLB player yet… which means he isn’t a member of the Union yet…
So why would the union file a grievance in this case?

Uh oh...It just got worse.
The MLBPA is siding with Boras on this one, and Hosmer is officially involved.
It appears that both the Alvarez and the Hosmer deals were given an extension by the Commissioner’s office to sign after the midnight deadline. The MLBPA is filing this grievance on that fact, supposedly, not for a ‘particular player.’
While I agree that a deadline needs to be a deadline, this is getting insane.
The following statement was issued today by Major League Baseball Players Association General Counsel, Michael Weiner:
"The Major League Baseball Players Association today filed a grievance challenging the unilateral decision of the commissioner’s office to extend the August 15, 2008 signing deadline for drafted players. The association and the commissioner’s office have agreed to expedited processing of this Grievance, with the intention of bringing the matter to hearing as early as September 10, 2008.
"In the 2006 round of collective bargaining, the Players Association agreed to establish an August 15 signing deadline for drafted players with remaining collegiate eligibility. The firm deadline was a club bargaining demand, and agreement on it was part of a broader set of compromises by the parties related to the reserve system and the draft.
"Within hours after this year’s August 15 midnight deadline passed, the Players Association learned from several sources that the Commissioner’s Office had extended the deadline for negotiating and reporting signings with drafted players. This was done without notice to or consultation with the Players Association, despite a firm deadline having been established through collective bargaining. The Players Association, after discussions with the Commissioner’s Office, players, agents and other parties, viewed it necessary to file a grievance challenging this plainly unlawful unilateral act by the Commissioner’s Office. The grievance was not filed on behalf of any particular player. It is the union’s obligation, on behalf of all players, to defend the integrity of its collectively bargained agreements and to ensure that those agreements are respected and honored by the clubs.
"I have read the statement issued by Frank Coonelly, president of the Pittsburgh Pirates, regarding Pedro Alvarez. Frank’s statement also refers to the contract between Eric Hosmer and the Kansas City Royals. The association, after further investigation and the processing of the grievance, will determine what relief it will seek from the arbitration panel, including whether it will seek relief related to agreements accepted by the Commissioner’s Office after the collectively bargained signing deadline.
“Moreover, based on information gathered to date by the association, Frank’s statement is inaccurate in a number of respects. While the association will not respond specifically through the press, we are confident that, at hearing, the panel will agree that the Commissioner’s Office acted improperly when it unilaterally changed the terms of the deal it struck with the association in 2006.”

Awesome. So there is a possibility that Boras knows that if it goes past midnight with an extension, and the MLBPA finds out, the MLBPA will stick it to the Commish and the owners for violating the CBA. Exploit any loophole he can get, I guess.
I think Callis said earlier today that the only three players who were granted an extension past midnight were two Boras clients (Alvarez and Hosmer) and the Hendricks brother’s Aaron Crow, who didn’t sign with the Nats. (Ironically, the Hendricks have been accused by some of ‘pulling a Boras’ with their tactics.) Fishy that it was only Boras guys and a guy who didn’t sign?

The MLBPA better tread carefully here, if they want to stick it to the owners. While this might violate the CBA (I need to the see the writing there to be sure—as an extension may not be a violation ipso facto), the MLBPA isn’t in great standing here. Since Alvarez has not signed, the issue goes to the verbal commitment, and verbal commitment alone might not count. If it does, then MLBPA can represent him, but verbal commitment can be attacked by ownership, particularly if a subsequent legal contract is refused (which not signing implies). If this is the case, Alvarez is legally in Aaron Crow land (or he can go with the original agreement—which is probably what Boras and Alvarez are banking on).
question: for a violation of the CBA, does the MLBPA need an actual case to push (that is, avlarez’s), or can they go after the violation as such? If it is the former, Alvarez has no standing.

I believe from what I’ve read, they’re going after the league office about the CBA and are not involving particular players—other than for use as examples—to do so. It seems like a sign or be released type of deal; not sure why Alvarez would turn down $6m after agreeing via technicality just so he can go back in the draft next year, though, I thought what Boras did with Hochaver (sp) and the Dodger was stupid too, and that turned out well for the player. According to one of the BBTF threads on this though, the Commish’s office has already fired back saying that this situation can’t be arbitrated under the CBA because it is a minor league contract. (Or something close; too tired to look it up…)
Regardless, going to be interesting to see how this one plays out.

There's a difference between not enforcing a deadline
and allowing the principals involved who clearly want the deal completed, a couple extra minutes to hash out all the details and send in the deal.

sounds like saber rattleing to me. The MLBPA wants to make sure the Commish will adivse them in the future if there is any extension of the deadline. The Commish will promise to make nicey nice, and this will blow over. No way either party wants Hosmer and Alverez go back into the draft. Boras is a complete dickhead for this. Pushing the system is one thing, but shitcanning the rules and hurting your client is another.

Why is this good for Boras/Alvarez? If this is all true, then Alvarez wasn’t sign before the deadline, which means he now can’t sign for another year. How is renegotiation even an option?

If Boras is allowed to renegotiate, which is what he wants, so that Alvarez’s contract is at least as much as Buster’s, then Boras use that fact to recruit future clients, i.e, market his firm by saying that his client got the biggest bonus in the last draft, etc. Right now he can’t do that. Obviously, he’s taking a PR hit and if he loses it will be awful for him, but if he stares down the Pirates and wins, it will only help him recruit future players, despite the short term PR hit he’s taking. In the long run, he’s still a douchebag.

Because this complaint is almost certain to end up at an arbitration hearing and that’s a conceivable ruling outcome. I can’t think of any other way Boras could imagine this comes out in his favor.

It’s that the Pirates eventually bypassed Boras and convinced Alvarez that maybe $6 million was a pretty fair offer, after all. Boras’ entire operation depends on the power of his negotiating tactics. But if the Pirates really offered $6 million on Day 1 and wound up signing Alvarez for $6 million, there wasn’t any need for Boras’ involvement at all.

I used to own a sweet ‘78 Cutlass Supreme. It was so awesome. It even got stolen and I got it back, but I was only 17 and drove like a maniac in it and didn’t maintain it as well as I could have and the engine crapped out. I traded it for an ’80 CS, which was a piece of shit…

I understand that that it wasn’t just Boras being difficult during the Posey negotiations, but that the Giants were being a bit unreasonable, at least at first. I heard that Sabean’s first offer was, “Eighty-nine cents is what we’re going to pay. Say hello to Bobby, he’s in the backseat. Give me something big, with a bunch of beef.”
Now, I don’t even know what that last part is supposed to be about….but, $0.89? That’s a pretty low offer for a Silver Spikes winner.

A little more speculation
In terms of the implications that much of this stems over the Boras Corp. being steamed that Buster Posey — and the agency who represents him, CAA — got more money than Alvarez did, here’s some food for thought.
- Someone in the industry told me that both Pedro Alvarez and Buster Posey had CAA and Boras Corp as their final two choices for representation. That’s been somewhat refuted in that someone else informed me Posey never met with a representative from Boras Corp in person. Could that add fuel to this fire, that Posey got more money — with Jeff Berry and CAA advising him — than Alvarez and wouldn’t even let Boras in the door to talk pre-draft?
- White Sox pitcher John Danks and his younger brother Jordan, fired Boras Corp after the first day of the draft this June, as reported by Scott Merkin on MLB.com (and other places). The younger Danks was drafted in the seventh round (day 2) of the draft and the University of Texas outfielder ended up signing for an above-slot deal, while being represented by… you guessed it, Jeff Berry and CAA. No reasons were given for the Danks-Boras split at the time, but I’ve learned that it stems from the Dankses learning Boras turned down money — that would have seen Jordan get selected in the first day of the draft — without checking in with his advisee.
If that part about Danks is true, then Boras is clearly engaging in some unethical conduct to the detriment of his clients.
