Bonds Positive Test?

I just heard on Andrew Siciliano's Fox Sports Radio Show that Barry tested positive for Steroids in November of 2001. Uh Oh.

The "OMG NO POSITIVE TEST" thing stopped being a part of my care well over a year ago. Sucks for him if it's true. If it is true, though, how the hell did it take this long to come out? Just weird.

Doesn't change how I feel about any of it anyway, mostly because it doesn't change my belief about what he did.

And because it doesn't have anything to do with the lie he's accused of telling. I think.

I'm sure I'm not the only Giants fan who sat watching the 73-homer season thinking "yeah, he's probably juiced, but it's fun!"

And I'm probably not the only Giants fan who finds the timing of this release just a wee bit suspicious, given Clemens' testimony yesterday.

it was bothering the government that people were focusing on someone other than Barry Bonds when it comes to steroids. They had to come out with this information.

Don't be so shocked. The government just called ABC 7 to tell them that 2001 was a typo on the document and this test was from 2000. So Barry's single season record remains unsullied.

Guys and gals lighten up.  These suposed steroid test failures were tests done thru Balco not MLB and will most likely not even be admissable in court because Conte chose a process that did not maintain a documented chain of custody.  In addition the tests were submitted to the testing lab under Anderson's name in most cases and whatever few might have been submited in Barry's name (one that I know of from Game of Shadows) was shortly thereafter (a matter of days) corrected to Anderson's name.  I just do not see how the government proves that the tests were actually Barry's.  There is nothing new here.

BREAKING NEWS: 2001 was a government typo. Apparently the test in question was from 2000 and is already known about or something.

Fairanu-Wada crawled out from under his rock to report on ESPN that this was nothing new. He had the nerve to say, "I hate to disappoint everybody." This is a prick that has gotten rich from profiting off of Barry Bonds thru information that was illegally given to him. The only "disappointment" is that Fairanu-Wada wasn't found dead lying next to Heath Ledger.

No one, even Bonds, is denying he took steroids. It's not like Clemens in that regard. Bonds is simply saying he didn't realize they were steroids. If they can prove he knew that was false, then he's guilty of perjury -- that's all that being fought over now, not whether he juiced. Lawyers help me here: is it also perjury if the jury concludes any reasonable person would have known under the circumstances (ie. constructive knowledge) or do they have to prove he was aware they were steroids?

Essentially, yes.  They'd have to prove either through direct testimony ("Hey, Bro, these roids kick ass!") or through proving far beyond a reasonable doubt that bonds, a man with an excellent knowledge of his own body, could not have possibly been unaware of what was being injected into his body.

The latter is very very very very hard to prove to any jury.

According to Game of Shadows it was not until 2003 that Balco switched Barry to the Cream and the Clear (steroids that at the time could not be detected by tests).  Barry acknowledged in his testimony that he used a cream that he was told and believed was an arthretic balm and a clear liquid that he was told and believed was flaxseed oil.  Neither Barry nor his lawyers have ever stated that they realized now that these actually were the steroids known as the cream and the clear.  But they have left open without saying so that this possibility does exist.

Otherwise Barry has infatically denied taking steroids and he and his lawyers hve never stated otherwise.  So, just where do you get the idea that "No one, even Barry, is denying he took steroids?

Which really does trivialize "perjury".  The Feds in the last several years have managed to make perjury less than, or equal to, an unsafe lane change.

I would buy the analogy that Treasury Agents used Income Tax Evasion to nab Capone for other unprovable serious crimes, or more recently RICO to nab serious WC criminals.

But here, the feds here are using "perjury" charges to ruin a man for extreme physical conditioning.

Same mentality used by some Police Depts to stop folks guilty of driving while Black.

It's funny that all of a sudden we care so much about what the athletes put into their bodies, what they do in their off time and who they sleep with.  Imagine Joe D. and Marilyn Monroe in today's world...all the tabloid shows would go ape shit getting the video and photos "you have to care about".  

Not to mention how Joe D. would have Yankee fans going, "Ehhh, you see thah dame Joe has on him...YOOOOOO!!!  I'd show her a good time...on Saturday night...you know, ya know!!!  Shrimp Alfredo good time, not artsie, fartsie movie good time.  Nope."

The first Gulf War never legally ended.  There was a cease fire agreement (not a surrender or peace treaty) that required Iraq to cooperate with weapons inspections.  Iraq ceased to coorperate and the Congress authorizied military action if Iraq did not reverse it's course and cooperate.  Iraq didn't so the war resumed.  There was absolutely nothing illegal about the war.  You may not like it because our intelligence gathering was wrong about weapons of mass distruction.  But, once Iraq stopped cooperating with weapons inspections what else did we have to rely upon other then our intelligence gathering?

I have no problem with you being against the war or wanting it to end ASAP.  You have every right to have this opinion.  But, what I do have a problem with is you and others making up false arguements to support this opinion rather then just going with the real (though not nearly as dramatic) arguements that are factual and support this opinion.

Prosecution Press Release
Yesterday, we released a filing stating that Barry Bonds had failed a steroid test in November 2001. Due to an unfortunate clerical error, a small inaccuracy was introduced. Instead of "2001", it should have read "2000". Also, instead of "Barry Bonds" it should have read "Armando Benitez". The word "steroid" was also a typo and should have read "donut".

We stand by the substance of our filing.
